Creatorboost Terms of Use

Welcome to Creatorboost! These Terms of Use ("Terms") govern your use of the Creatorboost Extension, plug-in, console, website, extension, or software (collectively referred to as the "App") provided by Creatorboost. ("Creatorboost," "Company," "we," "us," or "our"). By accessing and using the App, you ("User") represent any individual who engages with or employs the "App"; indicate that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these Terms, please refrain from using the App.

Acceptance of Terms

Your use of the App is subject to these Terms, the Google Chrome Web Store terms of use, our Privacy Policy available at docs.creatorboost.app/legal/privacy-policy, and any additional terms to which you agree when using particular elements of the App. You are responsible for regularly reviewing these Terms. Your continued use of the App after changes have been posted constitutes your binding acceptance of such changes.

App Description and Ownership

Creatorboost's App provides users with data and tools to plan, build, optimize, control, and scale their platform profiles in connection with social media networks. The App, its content, and all intellectual property rights related to them are the exclusive property of Creatorboost or its third-party licensors. Except as expressly granted in these Terms, all rights are reserved to Creatorboost.

User License

Creatorboost grants you a limited, revocable, non-transferable, non-sublicensable license to access and use the App solely for your personal, non-commercial purposes. This license is subject to these Terms and does not include any right to resell the App; collect and use any product listings, descriptions, or prices; make any derivative use of the App; download or copy account information for the benefit of another merchant; or use any form of data mining, robots, or similar data gathering and extraction tools. Any unauthorized use by you shall terminate the permission or license granted to you by Creatorboost and may result in legal action.

Disclaimer of Warranties

THE APP AND ALL CONTENT, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP ARE PROVIDED BY CREATORBOOST ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. CREATORBOOST MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE APP OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APP. YOU EXPRESSLY AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK.

To the full extent permissible by applicable law, Creatorboost disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Creatorboost does not warrant that the App, its servers, or email sent from Creatorboost are free of viruses or other harmful components.

Payments and Refunds

Creatorboost processes payments through external processors. By making a payment, you authorize the charge to your selected payment method for the full amount, including any applicable taxes and fees. Our App offers various subscription plans with different features, each subject to the specific terms provided at the time of purchase. Subscriptions auto-renew at the end of each subscription period and will continue indefinitely until canceled by the user. Users are responsible for all charges incurred under their account, regardless of who made the transaction.

Refunds are provided solely at Creatorboost's discretion and only in circumstances where required by law. To request a refund, users must contact support@creatorboost.app within 14-days from the transaction date. For payment disputes, users must contact Creatorboost to seek resolution before initiating a chargeback with their payment provider.

Indemnification

You agree to indemnify, defend, and hold harmless Creatorboost, its affiliates, officers, directors, employees, consultants, licensors, agents, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your violation of these Terms, or your infringement, or infringement by any other user of your account, of any intellectual property or other rights of any person or entity. Creatorboost will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

Governing Law and Jurisdiction

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these Terms or the App shall be filed only in the state and federal courts located in the United States and you hereby consent and submit to the exclusive jurisdiction of such courts for the purposes of litigating any such action.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Creatorboost, or its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, inability to use, or unavailability of the App. Under no circumstances will Creatorboost be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the App or your account or the information contained therein.

Creatorboost's total liability to you from all causes of action and under all theories of liability will be limited to the amount you have paid to Creatorboost for the App, if any, or, if Creatorboost has made the App available to you without charge, Creatorboost's total liability will be limited to $10.

Termination

Creatorboost reserves the right, without notice and in its sole discretion, to terminate your license to use the App, and to block or prevent your future access to and use of the App. Creatorboost may also impose limits on certain features and services or restrict your access to parts or all of the App without notice or liability.
